What the tribunal said
The tribunal assessed the open market rent based on local comparable properties and expert knowledge. Disrepair was disregarded in the valuation because the landlord made reasonable attempts to undertake repairs which were frustrated by the tenant's lack of cooperation.
The property
The property has disrepair including damaged ceilings in the downstairs front room and upstairs bedroom, and mould in the kitchen and bathroom. The tribunal disregarded this disrepair because the tenant unreasonably failed to cooperate to allow the landlord to carry out repairs.
