What the tribunal said
The tribunal determined that the open market rent for the flat in good condition with shared amenities (gym, lounge, rooftop terrace) would be 1625 per month if parking were included. Because parking is charged separately at 75 per month under the tenancy terms, a deduction of 75 per month was applied, bringing the market rent to 1550 per month. The tenant requested postponement of the effective date on grounds of undue hardship, but supplied only financial evidence that was over a year old, so the rent takes effect from the date in the notice.
The property
The property has double glazing and central heating. The tenant alleged a leaking roof causing damage and a defective electric meter, but the tribunal found these allegations were either unsupported or minor defects that did not warrant a rent reduction.
