Form 5: an agricultural occupancy notice served before 1 May 2026

Form 5 is the notice used to propose a new rent or licence fee under an assured agricultural occupancy of premises in England, for notices served before 1 May 2026.

What it is

Form 5 is the prescribed form for proposing a new rent or licence fee under an assured agricultural occupancy. Form 5A replaced it for notices served on or after 1 May 2026.

Being sent a Form 5 does not mean the notice is defective. It means it was served under the earlier rules.

The difference that matters

As with Form 4, a notice under the earlier rules does not carry the protection that stops a tribunal setting a figure higher than the one proposed. That is worth weighing before you apply.

What has to be on it

The same basic requirements apply.

  • It names every tenant on the tenancy, spelled correctly, including joint tenants.
  • It names the landlord — the actual landlord, not only the agent.
  • It gives the address of the property, including the flat number where there is one.
  • It states the new rent and the date it is to start.
  • It gives you at least the minimum notice before that date.
